Breaking News: Supreme Court Rules Against Sotomayor In ‘Reverse Discrimination’ Case

SCOTUS Says “Suck it, Sonia!”

Just moments ago, The Supreme Court has finally ruled on the Ricci v DeStefano case in which Supreme Court nominee Sonia Sotomayor ruled with other appeals court judges that the city had the right to disregard a promotion test for firefighters on which minority candidates fared poorly.

I wonder how Jeffrey Deskovic feels about this? If you follow that link, you will see that he personally responded to The Sibyl Speaks in the post we featured about him and his case, in which Judge Sotomayor refused to consider DNA evidence that would exonerate him from a murder charge that he spent years in jail for.

His comment on that post reads as follows:

“Please support me by joining my Facebook group “Judge Sotomayor Put Procedure Over Innocence In Deskovic Wrongful Conviction”, invite others to do so, and post comments in it related to the issue. Let’s make our voices heard!!!”

I have since established contact with Deskovic, and will be interviewing him before the end of the week

And Jeffrey, if you’re reading this, I think it would be safe to say you can count on us.  Not to worry – Your voice  and our voices will surely be heard.


Back to the SCOTUS ruling on the Ricci case:

The ruling was scheduled to be released just after 10 a.m.ET, and the timeline since this morning is as follows:


10:02 a.m. ET: Reuters, SCOTUSBlog and the Associated Press are reporting that the court voted 5-4 to reverse the decision made by Sotomayor and the other appeals courts judges in the case of the New Haven firefighters.

As AP writes:

The Supreme Court has ruled that white firefighters in New Haven, Conn., were unfairly denied promotions because of their race, reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge.

10:08 a.m. ET: Tom Goldstein at SCOTUSBlog writes that “the Court holds that the city’s fear of litigation cannot justify the refusal to apply the test. … In plain English — the city can’t be sued for throwing out the test results.”

10:11 a.m. ET: The court’s decision in the New Haven case is now posted here. The vote put the four “conservative” justices in the majority with Justice Anthony Kennedy, a frequent “swing” vote in recent years.

The five who voted to reverse the lower court:

Kennedy.

Chief Justice John Roberts.

Justice Antonin Scalia.

Justice Clarence Thomas.

Justice Samuel Alito.

The four who dissented:

Justice Ruth Bader Ginsburg.

Justice John Paul Stevens.

Justice David Souter (who retires at the end of today).

Justice Stephen Breyer.

10:20 a.m. ET. Interesting point from Tom Goldstein at SCOTUSBlog: Sotomayor’s position on the New Haven case “is the same as Justice Souter’s.” It is Souter whom she would replace on the bench.

    god forbid anyone should hold the wise latina back from HER promotion & forever lifetime job.
    just as in the private sector, any woman won’t do when you can screw all women by elevating the most biased underqualified token. Sonia will fit right in with the rest of Obama’s angry administration-white, black, asian, latino, Christian, Muslim, Jew. bho’s appointments are getting so predictable.

    I agree, but unfortunately I think she’s a shoo–in, thanks to BOTH parties tacit agreement to confirm (almost) any nominee a sitting President recommends.

    Your point is well taken, but what I think is even more alarming is that she is the perfect political choice for Obama. If you talk shit about her, you’re “racist” (of course), and “you just want President Obama to fail”.

    What people need to realize is that she will be on the bench long after Obama leaves the White House. Her incompetence will influence the laws that our children and grandchildren will be subject to.

    A judge that has absolutely NO empathy (as shown in her decision re: Jeffrey Deskovic despite Obama claiming that as her best qualification), and who obviously rules in a bigoted fashion should NOT be appointed to a lifetime anything, unless it’s a life sentence for taking 16 years of an innocent man’s life despite the DNA evidence that exonerated him.
