This is probably one of the most important things you can do to make a difference in this corrupt society that we live in today.
Consider being held as a hostage for 16 years in your own country, and the national seemse to be blacking this story out, and based upon the silence thus far by U.S. Senators of all political persuasions, nobody seems to care. The most hideous crime in America is putting politics over corruption. I am now trying to let the country know of my case, as well as trying to break through the media silence, while also getting Senators’ attention

Obama is more concerned with legal rights & compensation for enemy combatants at GITMO than with justice for his own citizens. if this failure of justice is as common as reported I’d like to know what our legislators plan to do about it. confirmation hearings would be a great place for them to survey Judge Sotomayor about what went wrong with the legal system in the Descovic case – actually demonstrate that claim of superior Latina wisdom.
she says judges actually legislate from the bench so that shouldn’t be too much of an imposition for a woman who’s getting a lifetime job.
after all, a 2nd chance at redemption is alot more than Jeffrey got.

Beach Walk 626 – The Innocence of Jeffrey Deskovic
It is a failure of justice. I can understand why there might need to be some finality to prevent repeated frivolous appeals based on procedural issues so as to avoid a victim or a victim’s family having to constantly worry they will never be able to go on with their lives after the crime. But when the issue is actual innocence and DNA evidence is available, it is criminal for a court to refuse to consider this. To make the appellant himself responsible for a minor miscalculation in determining when the petition should be filed is like holding the patient himself liable when a doctor does something like cut off the wrong leg. The truth is that clients and patients depend on the expertise of the lawyers and doctors they hire or who get appointed to represent them. If a mistake is made, sanction the person responsible, but not the client.
This is not like a civil action, in which a client can sue his attorney for money damages if a mistake is made. There is no remedy here, since it is his actual freedom at stake, except for the Court to hear his case; and it appears that if confirmed, Sotomayor will be an addition to Scalia’s “you got your due process, we don’t care if you’re innocent, so get back to your cell” club.

The DNA was offered early on, but refused consideration for many reasons.
First and foremost, there was an effort to suppress it because of elections (My guess is Sotomayor caved to the wishes of the DA and prosecutor – overturning the verdict would not look so good for them)
The part that galls me most is that the date for submission was provided by the court clerk. I would think (as previously stated) that the clerk’s word would be accurate.
TO DATE, THIS CASE HAS RECEIVED NO MEDIA ATTENTION NOR ATTENTION FROM CONGRESS. The Senate Judiciary Committee responded to Deskovic “We are doing everything in our power to get her confirmed”.
